Terms and conditions
Terms of use of this site, of subscriptions to the products on the pricing page, and the general framework for custom projects, each also governed by its written proposal.
Who provides the service
The services described on this site are provided by KINGSTER, LLC, a limited liability company organized in the State of Wyoming, United States ("Kingster").
Use of the site
The content of this site is informational. Nothing published here constitutes a binding offer, except the subscription plans on the pricing page, which are offered at the published price under the billing and refund policy. Custom services are contracted only through a written proposal accepted by both parties.
Subscriptions
By completing a payment for a subscription you accept these terms and the billing and refund policy. Subscriptions are intended for business and professional use.
A subscription grants a limited, non-exclusive, non-transferable right to use the product during the paid period, within the limits of the chosen plan. It does not transfer ownership of the software.
You are responsible for your account credentials and for the use made of the product by the people you give access to. You may not use the product for unlawful purposes, to infringe the rights of others, or to disrupt or probe the service.
Kingster may decline a subscription request, for example under the Restrictions section of the billing and refund policy.
Your data
The information you load into a product remains yours. For personal data of your own customers, users or insured persons that you load into a product, you act as the data controller, and Kingster, directly or through the technical operator identified on the product's site, processes it only on your behalf and following your instructions, to provide the service; it keeps it confidential, protects it with reasonable security measures and does not use it for any other purpose. You are responsible for having the authorizations the law requires to load that data. You can request an export of your data at any time and up to thirty days after your subscription ends; after that it is deleted, except records the law requires to be kept and usage records (such as broadcast logs) that no longer identify anyone. The privacy policy published on each product's site describes how that product processes data.
Availability, suspension and changes
Kingster works to keep the products available but does not guarantee uninterrupted or error-free operation, and may carry out maintenance. If a payment fails and is not resolved within fourteen days of the notice, access may be suspended until it is paid. Kingster may also suspend an account that breaches these terms.
Kingster may change prices or plan contents with at least thirty days' notice by email. The change applies from the first renewal after the notice; if you do not agree, you can cancel before it takes effect. If Kingster discontinues a product, it will give at least thirty days' notice by email and refund the unused part of any period already paid.
Services and scope
Each project is defined in a written proposal that sets scope, stages, timeline and price. What is not in the proposal is not part of the engagement; scope changes are quoted separately before being carried out.
Payments and refunds for custom projects
Custom projects are paid in stages as set out in the proposal, usually with an advance upon acceptance. Stages delivered and accepted by the client are non-refundable.
If the client cancels a project before an already paid stage begins, the amount paid for that stage is refunded, less the work performed and documented up to that date.
Intellectual property
Upon full payment, the code and deliverables developed specifically for the client become the client's. Kingster retains its own tools, libraries and components, which it licenses to the client for the use intended in the project. Third-party components are governed by their own licenses.
Build Record and Connecking subscriptions are provided and sold by KINGSTER, LLC. Third-party names and trademarks mentioned on this site belong to their respective owners.
Warranty and liability
For custom projects, defects reported within thirty days of a stage's delivery are fixed at no cost. Subscriptions are provided "as is" and "as available"; to the extent permitted by law, Kingster disclaims all implied warranties, including merchantability and fitness for a particular purpose.
To the extent permitted by law, Kingster's total liability is limited to the amount actually paid for the project in question or, for subscriptions, to the fees paid in the twelve months before the event giving rise to the claim. Kingster is not liable for lost profits, loss of data, or indirect or consequential damages. Nothing in these terms limits liability that cannot be limited by law.
Confidentiality
Information about the client's business that Kingster accesses during a project is treated as confidential and is not shared with third parties, except as required by law.
Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. In case of any dispute, the parties will first seek a direct, good-faith resolution for at least thirty days; failing that, the state or federal courts located in Wyoming will hear it. This does not deprive a consumer of the protection of the mandatory rules of the country where they reside.
General provisions
Kingster may assign these terms, and any subscription or project, to an affiliate or to a successor company that takes over its business, with notice by email; your rights and conditions stay the same. You may not assign them without Kingster's written consent. If the assignment requires moving your subscription to a new payment account, Kingster will tell you by email at least thirty days in advance; if you do not confirm your payment method with the successor, your subscription ends at the end of the period already paid, without penalty.
Neither party is liable for delays or failures caused by events beyond its reasonable control. If any provision is held invalid, the rest remains in force. Kingster sends notices to the email address associated with your account or project; you send notices to Kingster at support@kingsterpro.com.
Changes
If these terms change, the new version is published here with its update date. Material changes affecting active subscriptions are notified by email at least thirty days before taking effect. Ongoing projects are governed by the terms in force when their proposal was accepted.
